RENTAL AGREEMENT (Revised – Tonga Specific)
1. PARTIES & VEHICLE
The Rentor hereby rents to the Rentee identified in this Agreement the vehicle described, subject to all terms and conditions outlined herein. This Agreement shall be governed by the laws of the Kingdom of Tonga.
2. AUTHORIZED DRIVERS
The Vehicle shall only be operated by:
- The Rentee; and
- Any additional drivers approved in advance by the Rentor, aged 21 years or older, holding a valid driver’s licence recognized in Tonga.
3. PROHIBITED USE
The Vehicle shall not be used:
- For hire or reward;
- In any race, test, or competition;
- Outside Tongatapu without prior written consent;
- By unauthorized drivers;
- In breach of Tongan law;
- Under the influence of alcohol or drugs;
- To push or tow;
- Without securing the vehicle and keys;
- If warning lights or faults are present;
- To carry hazardous or illegal substances;
- Beyond permitted load capacity;
- On unsafe or unsealed roads likely to cause damage;
- With unsecured cargo.
Subleasing or transferring the vehicle is strictly prohibited.
4. RETURN OF VEHICLE
The Vehicle must be returned on time, at the agreed location, and in the same condition (fair wear and tear excepted).
Failure to comply may result in:
- Additional charges
- Termination of agreement
- Loss of insurance coverage
The Rentor reserves the right to repossess the vehicle if breached.
5. PAYMENTS & CHARGES
The Rentee agrees to pay:
- All rental charges
- Fuel differences
- Traffic fines (Tonga Police or authorities)
- Towing, recovery, or impound fees
- Damage and cleaning costs
- Legal/recovery costs
All charges are payable in Tongan Pa?anga (TOP).
6. INSURANCE, EXCESS & LIABILITY
The Vehicle is covered for collision damage only.
Standard Excess (Liability Amount):
- Compact Vehicles: TOP $3,000
- SUV / Hilux / Shuttle: TOP $5,000
This is the amount the Rentee is liable for in the event of damage.
Excess Reduction Options (Optional):
- $50/day → reduces excess to TOP $3,000 (for vehicles with $5,000 excess)
- $20/day → further reduces excess from TOP $3,000 to TOP $2,000
Excess reduction must be selected and paid at the start of the rental and is non-refundable.
Important Conditions:
The Rentee remains fully liable (up to full vehicle cost) if:
- The Agreement is breached
- An unauthorized driver is involved
- Driving under the influence
- Negligence or misuse of the vehicle
- Failure to report an incident
Insurance Does NOT Cover:
- Theft or vandalism
- Personal belongings
- Damage outside collision (unless stated)
- Third-party liabilities beyond policy limits
7. ACCIDENTS & REPORTING
In the event of an accident:
- Notify Rentor immediately
- Report to Tonga Police
- Provide all documentation
Failure to do so may void coverage.
8. INDEMNITY
The Rentee agrees to indemnify the Rentor against all claims, damages, or liabilities arising from use of the Vehicle.
9. REPAIRS
No repairs without Rentor approval. Unauthorized repairs are at Rentee’s cost.
10. CREDIT CARD AUTHORIZATION
The Rentee authorizes the Rentor to charge their card for all rental-related costs, including damages and outstanding balances.
11. GOVERNING LAW
This Agreement is governed by the laws of the Kingdom of Tonga. Any disputes shall be handled within Tongan jurisdiction.
